I was wondering, if a witch or wizard commits a crime like theft of a muggle store, or murder someone but with out using a wand, would he or she go to Azkaban or a muggle jail?

Well, muggle authorities might try to capture them - but if/when they fail (as magical beings are good at escaping muggle stuff) nothing would likely happen. Unless, of course, it gets enough attention to warrant the wizarding community stepping in. 
(Like if the Muggle Prime Minister contacts the Minister for Magic to investigate)
